Privacy Policy

This Privacy Policy explains how Advantage Systems Group LLC (“Advantage Systems,” “we,” “our,” or “us”) collects, uses, discloses, and protects information in connection with our software and services — the Shift Console (Advantage360), mobile application, cloud web back-office, Advantage Agent, websites, and related services (collectively, the “Services”).
This Policy works together with our Terms of Service and Data Processing Addendum. By using the Services, you agree to this Policy. If you do not agree, do not use the Services.
1. Two Roles: Controller and Processor
Our privacy responsibilities depend on whose information is involved:

As a service provider / processor. When we handle personal information within a customer’s account — for example, the customer’s employee records, house-account holders, or transaction data the Services are designed to process — we act on that customer’s behalf and at their direction. Our handling of that information is governed by the Data Processing Addendum and by our agreement with that customer, not primarily by this Policy. If you are an employee or customer of one of our business customers, please direct privacy requests to that business.

As a controller. When we collect information about our own relationship with you — for example, account registration details, billing contacts, website visitors, and support communications — we act as a controller, and this Policy governs.
2. Information We Collect
Information you provide to us:
- Account and contact data: name, business name, email address, phone number, mailing address, job title, and login credentials.
- Billing data: payment method details and billing contact information (card data is processed by our payment processor; we do not store full card numbers).
- Support and communications data: information you provide when you contact us, request support, or respond to surveys.
Information collected automatically when you use the Services or our websites:
- Device and usage data: IP address, browser and device type, operating system, pages and features accessed, dates and times of access, and diagnostic and performance data (including crash and error reports).
- Cookies and similar technologies: see Section 6.
Information within customer accounts: business, inventory, sales, fuel, lottery, transaction, and similar operational data, which may include personal information of the customer’s employees or end-customers. We process this as a service provider/processor under the Data Processing Addendum.
Information from other sources: we may receive information from your authorized integrations (for example, point-of-sale systems you connect) and from service providers that help us operate, secure, and improve the Services.
3. How We Use Information
We use information that we control to:
- provide, operate, maintain, secure, and improve the Services;
- set up and administer accounts, authenticate Users, and provide support;
- process payments and manage billing;
- communicate with you about the Services, including service, security, and administrative messages;
- monitor, detect, and prevent fraud, abuse, and security incidents;
- comply with legal obligations and enforce our agreements; and
- with your consent or as permitted by law, send product news and offers.
We may create and use de-identified and aggregated data that does not identify you or any individual for any lawful purpose, including analytics, benchmarking, and improving the Services.
4. How We Disclose Information
We do not sell personal information for money. We may disclose information:
- to service providers (for example, cloud hosting, payment processing, error monitoring, and analytics) who process it on our behalf under contracts that restrict their use of it;
- to a customer, where the information belongs to that customer’s account;
- in connection with a business transaction such as a merger, acquisition, financing, or sale of assets, with the information transferred as part of that transaction;
- to comply with Law, legal process, or governmental request, or to enforce our agreements; and
- to protect the rights, safety, and property of Advantage Systems, our customers, or others.
5. Mobile / SMS Information
If we offer text-message communications, we will collect the mobile number and consent preferences you provide and use them only to send the messages you request (such as account, service, or — if you opt in — promotional messages). We do not share or sell mobile numbers or consent information with third parties for their own marketing purposes. Message frequency varies; message and data rates may apply; consent is not a condition of purchase. You may opt out by replying STOP and get help by replying HELP.
6. Cookies and Tracking
We use cookies and similar technologies to operate our websites and Services, remember preferences, authenticate Users, and analyze usage. You can control cookies through your browser settings; disabling them may limit functionality. We honor recognized opt-out signals (such as Global Privacy Control) where legally required.
7. Data Retention
We retain information for as long as needed to provide the Services, maintain your account, comply with legal obligations (including tax and recordkeeping requirements), resolve disputes, and enforce our agreements. We may retain de-identified and aggregated data indefinitely. Information within customer accounts is retained and deleted as described in the Terms and the Data Processing Addendum.
8. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and monitoring. No system is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials and devices and for notifying us of any suspected unauthorized access.
9. Your Privacy Rights
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information; to opt out of certain processing; and to not be discriminated against for exercising these rights. Residents of California, Virginia, Colorado, Connecticut, Texas, and other states with comprehensive privacy laws may have these and similar rights. If your request concerns personal information within a business customer’s account, we will refer the request to that customer, for whom we act as a service provider/processor. To make a request about information we control, contact us using Section 12. We will verify your identity before responding and may decline requests as permitted by law. You may use an authorized agent.
10. Children
The Services are intended for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided personal information, contact us and we will delete it.
11. Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a new “Last Updated” date and, where required, provide additional notice. Changes are effective when posted unless stated otherwise.
